摘要:
在我国,由于国家建设用地使用权的期限性和地上建筑物存续期间不一致,再加上我国没有采用土地吸附房屋的一元立法模式,因此会产生建设用地使用权届满后续期的问题和地上建筑物归属等诸多难以解决的问题。我国《物权法》的出台和实施,并没有解决建设用地使用权届满后的续期问题和地上建筑物的归属问题。本文对我国物权法及相关法律法规对建设用地使用权届满后续期的问题和地上建筑物归属的立法进行分析,提出了应明确续期期限、次数和出让金数额等立法建议。
Abstract:
In china, because the term of the use right term of the right to the use of state-owned construction land and the duration of the above-ground buildings are not the same, and the legislation mode of land’s embracing buildings isn’t adopted in china, there are many problems such as extension after the expiration of the right to the use of state-owned construction land and adscription of above-ground buildings. With the implementation of The Right Law of the People’s Republic of China, those weren’t solved. The author tries to analysis the relevant laws and regulations on those problems, and puts forwards some legislation advice on making certain the times and the term of extension of the right to the use of state-owned construction Land, the amount of the paid-in land transfer fund.
