摘要:
施工合同订约与履行是构成我国建筑业市场交易的主要基础，而作为国家推行的施工合同示范文本，因其广泛的影响力和强烈的引导性，对建筑业发展、促进建筑市场交易的公正性及效率、保障合同当事人合法权益等，均有重大作用。通过对1999版《建设工程施工合同（示范文本）》在应用中暴露出的问题进行多视角审视，分析对其进行修改的背景、原因、方向和必然性。依据法律渊源、法律体系等理论，结合2013版《建设工程施工合同（示范文本）》的内容，揭示了其取得合同立法新发展的技术路径和相应成果。
Abstract:
Construction contract contracting and performance mainly constitute the basis of China’s construction market transactions, because of its extensive influence and strong guidance, a construction contract model text of the nation has great effect to develop construction industry, promote the fairness and the efficiency of the construction market ,and protect legitimate rights and interests of the parties of contract. The 1999 edition of construction contract (model text) exposed the problems in its application. From multi perspective, the paper analyzes the background, reason, direction and the necessity of modification to 1999 version. According to the sources of law and the legal system theory, combined with the new 2013 version of construction contract (model text), it reveals the path and corresponding results of obtained new development in contract legislation
