摘要:
结合建筑业的实践，通过对相关法律法规的研究，重点探讨了我国目前建设工程法制化存在的若干问题。这些问题包括：《中华人民共和国建筑法》不够完善；建设工程质量立法位阶偏低；建设工程程序性管理立法不够严肃；建筑业企业信用规制法律化手段薄弱；广大农村民居建设工程质量管理缺乏有效立法；农民工用工资格缺乏法律规制等。通过对上述问题的分析，从立法角度提出了四条完善建设工程法制化的对策建议。

Abstract:
Combined with the practice of construction industry, some defects in the legalization of construction in China are mainly discussed by researching the relevant laws and regulations. These problems include: “Construction Law of the People’s Republic of China” is not a complete system; the legislation of construction quality is not paid more attentions; the procedural legislation of construction is not serious, the legalization of credit regulation of construction enterprise means weak; The quality management of construction in vast villages is lack of effective legislation; the accepting qualification of migrant workers is lack of legal regulation and so on. According to the analysis of the problems, four suggestions are put forward to promote the legalization of construction from the perspective of legislation
