摘要:
 教育体制改革所指涉的首先是体制本体,其次才是基于应然对实然的批判而折射出来的体制改革的价值趋向。当我们把公平作为教育体制改革的价值趋向时,就会发现教育公平所涉及到的问题都与教育体制本体是否具有某种正义美德有关。体制正义内含着体制所承担的责任。以法律的形式确保公民公平地享有受教育权利,能够表现出教育体制的正义品格。既然宪法已经赋予公民享有受教育权利,那么,作为体制的建构者,国家则必须保障公民能够切实地享受到该权利,并且让每一位公民的受教育权利都能得以公平实现。

Abstract:
 The educational system reform refers to the system itself at first, secondly the critique between “should-be” and “actual”reflects the value tendency of the educational system reform .When we think of the fair as the value tendency of the educational system reform , we will find that all the problems involved by the educational fair relate to whether the educational system has a certain justice virtue. The educational system justice contains the responsibility undertaken by the system. We make sure that the citizens fairly possess the receiving educational right by the form of the law and can express a justice character of the educational system.Now that the constitution has already given a citizen the receiving educational right ,that is, as the builders of the educational system, the nation has to guarantee a citizen practically to enjoy the right, and make sure that the receiving educational right of each citizen can be fairly realized.
