摘要:
行政不作为是一种行政侵权行为,研究它的精神损害赔偿问题有重大的理论意义和实践意义?对行政不作为精神损害赔偿的界定以及对适用中的相关具体措施的探究,必将进一步完善行政行为的基础理论,精神损害赔偿应当成为行政不作为救济措施中不可或缺的一种有效方式?
Abstract:
Administrative omission as a administrative tort,the spiritual damage compensation problem is of great theoretical significance and practical significance.To define administrative omissionspiritual damage compensation and the concrete measures related to apply the inquiry,will further improve administrative behavior of the basic theory,the spiritual damage compensation should be a kind of effective method in relief measures of administrative omission.
