摘要:
中国目前现有的公证立法不完善,公证纠错机制方面,尚未建立起完整的公证法律制度,现有的法律规定过于原则,缺少可操作性?有必要对各发达国家的公证纠错机制进行比较借鉴,以解决我国公证纠错立法方面的缺陷,提出完善公证纠错立法的建议,加强公众对司法的信任以及对社会公信力的肯定?
Abstract:
The legislation of notarization in China is imperfect in the aspects that there is a lack of an over-all notarization law established with the error-correction mechanism,and that the existing legal provisions are too principled but less operable.It is necessary to take the notarization error-correction mechanism of the developed countries as the reference,to remedy the defects in the legislation of Chinese error-correction mechanism.The paper puts forward improvements of perfecting the notarization error-correction legislation to strengthen the public trust in the judiciary and the public affirmation of social credibility.
