新中国成立以后,通过大量的实践和摸索,我国逐步找到了保护农民集体土地利益的有效方法———民主议定原则,并通过立法加以确立。该原则是实现村民自治,维护本集体经济组织成员合法权益,增强基层民主意识的重要途径,在保护农民集体土地利益方面无疑具有中国特色并且行之有效。通过结合司法实践,分析该原则在法律适用中存在的问题,提出行之有效的解决对策。

After the founding of new China, through a lot of practice and exploration, our country gradually fond out the effective method to protect the interests of the peasant collective land-the principle of democratic agreed and passed legislation to establish it. This principle is the inmportant way of achieving autonomy ,safeguarding the interests of members of the collective economic organization and and enhancing awareness of the grassroots democracy and in the protection of farmers’ collective land interests with Chinese characteristics and effective. Combined with judicial practice, the paper analyze the existing problems in the application of the law and put forward effective countermeasures.
