摘要:
新民诉法、新环保法和最高院《关于审理环境民事公益诉讼案件适用法律若干问题的解释》相继施行,环境公益诉讼在我国进入到了新的发展阶段,关于环境公益诉讼的原告主体进步与问题并存。对于环境公益诉讼原告主体资格取得的理论基础,运用法定诉讼担当理论可以得到合理的解释。正是由于原告主体资格的获得是基于法律的授权,所以近两年来法律的不断变化才对我国环境公益诉讼原告主体乃至整个环境公益诉讼制度的发展产生了重大的影响。现有法律应当进一步放宽环保社会组织参与环境公益诉讼的条件,同时明确赋予检察机关和环保行政机关提起环境公益诉讼的权利,并对相关程序性问题进行明确规定。
Abstract:
With the implementation of new Civil Procedure, new environmental law and the Supreme Court “ the issues of interpretation on the trial of civil public interest litigation environment applicable to” , environmental public interest litigation in China has entered into a new stage of development, progress and problems on the plaintiff body of environmental public interest litigation coexist. Theoretical basis for obtaining the qualification of the environmental public interest litigation plaintiff, using legal litigation take on can serve as a reasonable explanation. It is precisely because the plaintiff to obtain the qualification is authorized by law, the changing of laws has had a major impact on the development of the environmental public interest litigation plaintiff and even the entire system recent years. The existing laws should further expand the conditions of environmental social organizations to participate in environmental public interest litigation, while clearly giving prosecutors and environmental executives the right of filing environmental public interest litigation. And the law should clearly define the procedural issues.
