20世纪90年代初我国建立了商品房预售合同登记备案制度,司法界主流观点认为商品房预售合同登记备案不具有物权公示作用,不产生准物权效力。在此观点下,商品房预售合同登记备案制度存在不能保护购房人权益的诸多问题。同时我国还存在商品房预告登记制度,经预告登记的商品房产生准物权的效力,在保护购房人权益方面有明显优势。综合比较商品房预告登记制度与商品房预售合同登记备案制度,发现这两个制度有明显的同质性和相似性。从保护购房人利益的角度考虑及理顺我国商品房预售登记管理法律体系的角度出发,笔者认为商品房预告登记制度应当吸收合并商品房预售合同登记备案制度。

In 1990s, China established the registration and filing system of commercial housing pre-sale contract. The mainstream view in the judiciary is that without the function of real right publicity the registration and filing of the pre-sale contract of commercial housing has no effect of quasi real right. In this case there are many problems where the registration and filing system of the pre-sale contract of commercial housing can not protect the rights of the buyer. There is also an advance notice registration system of commercial housing in China, which can produce the effect of quasi real right and has obvious advantage in protecting the rights of buyers. Comparing comprehensively between the two contract systems above, the paper finds that both of them are of obvious homogeneity and similarity. From the perspective of protecting the rights of buyers and rationalizing the China's legal system of pre-sale registration of commercial housing, the author believes that the commercial housing advance notice registration system should consolidate the registration and filing system of commercial housing pre-sale contract.
