摘要:: ?近十年来，信息革命的迅猛发展造就了一批信息产业巨头，但让这些大企业困惑的是：他们通过创新取得了成就，却频频触动“垄断”的高压线。科技创新似乎与反垄断法之间有着不可调和的矛盾，也给反垄断法“维护市场竞争、保护消费者利益”的价值目标带来了冲击。本文试图提出缓解这种矛盾的三种途径：明确反垄断法的基本价值是保护竞争，广泛适用合理原则，以及慎用剥离制度，并提出中国应对科技革命，反垄断立法及执法的建议。

Abstract:: ?In recent ten years, the fast-going Information revolution has triggered the emergence of plenty giants in information industry. However, what makes those giants confused is that the achievements of their innovation always break the bottom line of anti-monopoly. There seem irreconcilable contradictions between technical innovation and ant-monopoly law, of which the fundamental conflict is to the basic goal of anti-monopoly law: to maintain market competition and protect consumers’ interests. In order to ease such contradiction, three approaches shall be adopted: to ensure that the basic value of anti-monopoly law is to protect competition; to apply the “rule of reason” principle widely and the divestiture mechanism reasonably. On such basis, the author will make some suggestions on the legislation and enforcement of anti-monopoly law in China to tackle with technology revolution.
