摘要:
地热能资源作为一种清洁可再生能源，为了对地热资源进行科学合理的开发利用，国外发达国家及国内部分省份都对地热资源进行专门立法。西藏自治区的地热资源的广泛开发利用与西藏自治区当前的地热资源开发利用的相关法律法规的缺失、相关的地热能法律、法规的操作性不强、缺乏相应的激励机制等密切相关，西藏自治区应当在进一步的协调现行的有关地热资源开发利用的法律法规的前提下，制定统一的《西藏自治区地热资源开发利用法》及与之相配套的政府规章，以法律的形式来消除地热资源在开发利用中存在的障碍，既可以保障西藏自治区地热资源的可持续开发利用，同时也符合国际地热资源开发利用惯例。
Abstract:
In order to exploit scientifically and rationally the geothermal resources, one of the clean and renewable energy, the developed countries abroad and some provinces at home have enacted special legislations. However the problems in the wide development and utilization of geothermal resources in Tibet Autonomous Region are closely related to such issues as the lack of relevant laws and regulations, the weak operability of these laws and the shortage of incentive mechanism. On the condition of further coordinating existing laws and regulations, Tibet should formulate a unified "Tibet Autonomous Region Development and Utilization Law of Geothermal Resources" and the related government regulations. Removing the obstacles legally in the development and utilization of geothermal energy guarantees the sustainable development and utilization of geothermal resources in Tibet Autonomous Region and accords with international development and utilization of geothermal resources
